Pre-made training programs

We reserve the right to modify, update, or discontinue Services at any time without liability.
4. No Medical Advice
Physique D’or does not provide medical, diagnostic, or therapeutic advice.
The Services are strictly educational and fitness-oriented.
You understand and agree that:
Our coaches are not acting as medical professionals
The Services are not a substitute for medical advice or treatment
You must consult a qualified healthcare provider before beginning any fitness program
You are solely responsible for your health and safety
If you experience dizziness, fainting, pain, or any concerning symptoms, stop the activity immediately and seek medical attention.
5. User Responsibilities
By using the Services, you agree that you will:
Provide accurate and complete information about your health, injuries, or limitations
Follow all instructions safely and at your own risk
Not engage in harmful, unsafe, or reckless behaviour while following training guidance
Not misuse or redistribute proprietary content belonging to Physique D’or
You assume all risks associated with physical activity and the use of our Services.
6. Payments, Billing, and Subscriptions
6.1 Payment Processing
Payments on this website are processed through third-party payment providers (e.g., Stripe, PayPal, or Squarespace Payments).
Physique D’or does not store credit card details.
6.2 Subscription Billing
Some Services operate on automatic recurring billing.
By purchasing a subscription, you authorize recurring charges until you cancel.
6.3 Cancellations
Unless otherwise stated:
Subscriptions may be cancelled at any time, effective at the end of the current billing cycle
You must cancel through your account dashboard or email us directly
Cancelled subscriptions are not refunded for the current billing period
6.4 Refunds
All sales of digital products, training plans, coaching, and subscriptions are final, except where required by law or where expressly stated by Physique D’or.
We do not provide refunds for:
Partially used services
Missed coaching sessions
Failure to follow training plans
Dissatisfaction stemming from personal preference
Custom refund policies may apply to in-person coaching.
7. Intellectual Property
All content, including:
Branding, trademarks, logos
Website design and layout
Training plans, PDFs, and downloadable materials
Videos, images, and written content
Program structures and coaching methods
is owned by Physique D’or or licensed to us, and is protected by copyright, trademark, and intellectual property laws.
You may not copy, modify, reproduce, share, republish, distribute, or create derivative works without our express written consent.
8. User Content
Any content you upload or submit (e.g., progress photos, messages, form entries, videos) remains yours, but by submitting it, you grant Physique D’or a non-exclusive, worldwide, royalty-free licence to:

Store and process the content
Access it for coaching, communication, or platform administration
You may request deletion of such content at any time, subject to legal and contractual obligations.
You agree not to upload unlawful, defamatory, harmful, or otherwise inappropriate content.
9. Squarespace Platform Usage
Physique D’or operates through the Squarespace platform. As a result:
Website performance, uptime, and availability are subject to Squarespace’s systems
Payment processing relies on Squarespace’s approved providers
Some data may be processed by Squarespace under their own policies
Squarespace may collect analytics or performance data independent of Physique D’or
You agree to comply with Squarespace’s Terms of Use to the extent they apply to your activities on our site.
10. Third-Party Services
Our Services may integrate with third-party platforms (e.g., fitness apps, communication tools, payment processors).
We are not responsible for the content, practices, or policies of those third parties.
Your use of third-party services is governed by their own terms.
11. Limitation of Liability
To the fullest extent permitted by law:
1. You use the Services entirely at your own risk.
2. Physique D’or is not liable for any injuries, health issues, or damages resulting from your participation in fitness activities.
3. Physique D’or is not responsible for:
System failures, downtime, or interruptions
Errors or inaccuracies in content
Lost profits, lost data, or incidental or consequential damages
Any third-party actions, omissions, or failures
Our maximum aggregate liability to you shall not exceed the total amount you paid to Physique D’or in the three (3) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Physique D’or, its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
Your breach of these Terms
Your use or misuse of the Services
Any injury or damage you sustain while following training guidance
Any content you submit
13. Termination
We may suspend or terminate your account or access to the Services, without notice, if:
You violate these Terms
You misuse or distribute proprietary content
You engage in threatening, abusive, or inappropriate conduct
We discontinue the Services
You may terminate your account at any time by contacting us.
Even after termination, Sections relating to intellectual property, disclaimers, liability limits, and indemnification will remain in effect.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario, and the applicable laws of Canada, without regard to conflicts of law principles.
Any disputes must be brought before the courts of Ontario.
15. Changes to the Terms
We may update these Terms from time to time.
When changes occur, we will update the “Last Updated” date at the top of this page.
Your continued use of the Services constitutes acceptance of revised Terms.
